General Terms and Conditions (GTC) and Consulting Agreement

For reasons of better readability, the masculine form is used for personal designations and personal nouns in the GTC. Corresponding terms apply to all genders in the sense of equal treatment. The abbreviated language form is for editorial reasons only and does not imply any evaluation.
On the basis of these General Terms and Conditions (GTC), the following consulting agreement is concluded between the client or customer and

the following consulting agreement is concluded:
§ 1 Subject of the Agreement
The client makes use of psychological counseling provided by the consultant. The client and consultant can jointly formulate a counseling concern. The joint work includes one or more sessions, depending on the booking, and upon request also other working methods such as relaxation exercises (e.g., progressive muscle relaxation) to improve sensory, mental, and/or physical perception.
The counseling focuses on, among other things, aggression reduction, emotional processing, mental and physical relaxation, personality development, resource activation and goal setting, stress management, grief processing, as well as coping with all types of psychosocial crises and/or problems.
The counseling sessions take place exclusively online via video call or by telephone. The preferred language for counseling is German, however, I also offer counseling in English upon request and by arrangement.
The service does not relate to the diagnosis, cure, or alleviation of disorders with disease value or the therapeutic treatment of psychological disorders. Instead, the focus is on coping with and overcoming emotional, mental, or social conflicts and other purposes outside the field of medicine (cf. Psych. Th. G. §1 Para. 3 Sentence 3).
§ 2 Counseling Units, Packages, Counseling Location, Fee, and Payment Terms
The duration of a counseling session is usually 60 minutes. There are three different 60-minute sessions. The higher-priced session is usually for coaching, followed by couple counseling. The lower-priced 60-minute session is usually for an individual. When two 60-minute sessions are combined, a double session of approximately 120 minutes results. The specified times and prices in the price list also apply to packages.
The costs amount to €170 for a 60-minute individual session, €185 for a 60-minute couple session, and €200 for a coaching unit. Prices for the packages can be found on the website and are current as of the day of viewing. The fee includes sales tax. The same costs apply for appointments that take place after 5:00 PM or on weekends. The costs for the initial consultation and the final session correspond to 100% of the fees for a regular unit.
The fee is due in advance.
The booked services (packages, individual sessions, coaching, or couple counseling) have a validity period of six (6) months. The period begins on the day of the binding booking. After the expiration of the six months, the entitlement to services not yet used expires without replacement.
The counseling takes place exclusively via video call or by telephone. The counseling sessions must be booked by the client exclusively through the appointment calendar on the website SallySchulze.de or in consultation with Sally Schulze. After each booking, the client will receive an invoice by email. If the client does not receive the invoice immediately after booking, the consultant can, if necessary, issue a new invoice, but this is not mandatory. The available payment methods correspond to those that are marked as available on the website SallySchulze.de as of the current day.
The client should note that the services of psychological counseling are not reimbursed by statutory health insurance.
§ 3 Counseling Success
The consultant cannot guarantee that the success sought by the client or the achievement of any set goals in the joint work are guaranteed. Nevertheless, both parties engage to the best of their knowledge and using all available means and abilities to promote the success of the counseling. The determination of the desired goals, the selection of discussion topics, and the implementation of the developed solution approaches are the responsibility of the client.
§ 4 Counseling Duration
The duration of the counseling depends on the number of sessions booked. However, to pursue certain goals, it is recommended to hold counseling sessions to the extent of several sessions (see also § 2 Counseling Units, Counseling Location, Fee, Payment Terms).
§ 5 Termination
The consulting agreement can be terminated 48 hours before the next session. In case of termination during the session, the session fee remains unaffected.
§ 6 Appointments, Delays, and Appointment Cancellation
Appointments are arranged and booked by the client independently on the website SallySchulze.de or in consultation with the consultant. If the client arrives late for an agreed appointment, the treatment time will be shortened accordingly.
The booked treatment appointments are fixed appointments that are reserved exclusively for the client. If the client misses an agreed appointment without timely cancellation, they will owe the consultant 75% of the agreed fee for this session.
This payment obligation does not apply if the counseling appointment was canceled at least 48 hours in advance or if it had to be canceled at short notice due to a serious event. In the latter case, the client should inform the consultant early about the hindrance and, if necessary, provide appropriate evidence.
If the client cannot attend an agreed appointment, they must inform the practice in writing, by email, or by telephone about the hindrance, providing their name, treatment date, and time.
Appointments can be rescheduled up to 3 (three) hours before the appointment, but even in this case, the consultant should be informed early about the hindrance. If more than 3 (three) appointment reschedulings occur, the consultant reserves the right to cancel the contract with the client.
§ 7 Confidentiality
The consultant undertakes to maintain confidentiality towards third parties. The obligation of confidentiality begins with the first contact. Information may only be disclosed to third parties, including the partner in couple counseling, with the written consent of the client. However, the obligation of confidentiality does not extend to situations where alleged criminal offenses must be prevented or prosecuted or when it concerns the protection of more important legal interests. The confidentiality obligation does not include the right to refuse testimony, which would take effect during psychotherapy or medical treatment.
If suicidal actions are announced and the ability or willingness to contact a specialist, therapist, or clinic is lacking, the consultant will immediately contact the relevant authorities to ensure the client's safety as best as possible and prevent potential endangerment.
§ 8 Health Status and Parallel Psychotherapy
The client assures that they do not suffer from any illness or disorder that impairs their legal capacity or that currently precludes counseling for medical-psychological reasons.
If the client is currently undergoing psychotherapy or such has been recommended, then this must be communicated to the consultant immediately. The client permanently informs the therapist of the psychotherapy about the counseling (type, topics, goals, etc.). If the therapist does not agree to the counseling, it will be terminated immediately.
§ 9 Counseling Exclusion
If the consultant gains the impression during the counseling conversation that the client shows psychiatric abnormalities or is confused, the counseling conversation can be terminated, with the request to seek appropriate treatment.
Similarly, clients who are under the influence of drugs and/or whose questions are based on criminal offenses may be rejected by the consultant and the counseling conversation will consequently be terminated.
§ 10 Documentation and Data Protection
The consultant documents and archives the course and relevant findings of the counseling conversations, including the anamnesis form, topic-specific questionnaires, and notes on the contents, results, and agreements of all counseling sessions. Additionally, the client's personal data is stored to the extent necessary for invoicing, service provision, and bookkeeping. This personal data includes first name, last name, telephone number, email, address, billing address, type of payment, payment information, and bank details.
The client agrees to the collection and archiving of this data.
§ 11 Jurisdiction, Liability, Self-Responsibility
The place of jurisdiction is 60487 Frankfurt.
Ms. Sally Schulze (consultant) is liable to the client only to the amount of the paid counseling fee for any damages that allegedly or actually arise from the joint work.
The client acknowledges that she/he is fully responsible for her/his physical and mental health throughout the entire counseling process, both during the individual counseling session and during the time between individual counseling sessions. She/He acknowledges that all steps and measures taken within the framework of the counseling sessions are only within her/his own area of responsibility. She/He undertakes to report actions with far-reaching consequences to Ms. Schulze and to discuss these in advance.
§ 12 Severability Clause
Should any provision of this agreement be or become invalid, the remainder of the agreement shall remain valid.
